Terms of Service

1. Agreement and Acceptance

By creating an account or using VeySur, you agree to these Terms of Service ("Terms"), our Privacy Policy, and our Data Processing Agreement. If you don't agree, you can't use the Services.

Who can use VeySur:

  • You must be at least 18 years old
  • If you're acting for a company, you confirm you have authority to bind that company

Who we are: "VeySur," "we," "us," or "our" means VeySur Limited, a company registered in England and Wales at c/o DoES Liverpool, 1st Floor, The Tapestry, 68-76 Kempston Street, Liverpool, L3 8HL, company number 17297318.

What we provide: "Services" means our survey creation, hosting, distribution, and analytics platform. "Account" means your user account, which can contain multiple Projects. "Project" means a workspace with its own surveys and subscription plan. "Content" means all data, surveys, questions, and responses you create or collect.

2. Your Account

Creating and Securing Your Account

To use VeySur, create an account with your email, name, and password. You must provide accurate information and keep it up to date.

Your responsibilities:

  • Keep your password secure and confidential
  • You're responsible for all activity under your account
  • Tell us immediately if someone accesses your account without permission (email support@veysur.com)
  • Don't share your login credentials

We can refuse registration or cancel accounts that provide false information or violate these Terms.

3. What VeySur Does

VeySur provides online survey tools including:

  • Survey creation: Build surveys with various question types, branching logic, and custom branding
  • Hosting and distribution: We host your surveys and make them accessible to participants via secure URLs
  • Data collection: Collect and securely store responses in real-time
  • Analytics and reporting: View responses through dashboards, generate reports, and export data

4. Subscription Plans and Pricing

Plan Types

We offer free and paid subscription plans. Each Project has its own plan, and you can have multiple Projects with different plans.

Upgrading:

  • Takes effect immediately
  • You're charged for the new plan and receive a pro-rata refund for your old plan
  • You get immediate access to new features

Downgrading:

  • Takes effect at the end of your current billing period
  • No refund for the remainder of your current period
  • You can cancel a scheduled downgrade before it takes effect
  • Important: Downgrading may affect your resource limits. See the Free Plan section below for details on resource management when downgrading

Billing and Payment

Billing cycles: Choose monthly or annual billing. Subscriptions purchased on the 29th-31st renew on the 1st of the month.

Payment: We accept credit and debit cards through Stripe. By providing payment info, you authorise us to charge your card. If payment fails, we'll notify you and give you time to update your details before suspending your subscription.

Currency: All charges are made in British Pounds Sterling (GBP). Where we show an equivalent amount in another currency (for example, on the pricing page), it's an estimate for reference only, based on prevailing exchange rates, and isn't the amount you'll be charged.

Auto-renewal: All paid subscriptions automatically renew unless you cancel. We'll email you at least 3 days before renewal with the amount and renewal date.

Price changes: We'll give you 1 month's notice before any price increase. If you don't agree, cancel before the new price takes effect.

Taxes: All prices exclude taxes (VAT, GST, sales tax). Taxes are calculated and shown before you complete your purchase.

Refund Policy

14-day money-back guarantee: Cancel within 14 days of your first purchase for a full refund, no questions asked. This applies only to your initial purchase, not renewals or plan changes. A refund under this guarantee reverts your Project to the Free Plan immediately.

After 14 days, fees are generally non-refundable. Cancelling stops future renewals, so you won't be charged again, but you keep your paid subscription and its features until the end of your current billing period, at which point your Project reverts to the Free Plan. (Warranty refunds may still apply - see Section 13.)

Free Plan

The Free Plan has limits on responses, storage, features, and support. We can modify or discontinue the Free Plan anytime. See our pricing page for current limitations.

Project creation limits:

  • You can only create one project with a Free subscription plan
  • If a Free project already exists on your account, creating additional projects requires a paid subscription
  • Exception: You may have multiple Free projects on your account only if they were previously on paid subscriptions that were cancelled or downgraded. When you cancel or downgrade a paid subscription, that project automatically reverts to the Free Plan.

Resource limits when downgrading:

If you downgrade from a paid plan or cancel a subscription, and your project exceeds the Free Plan's resource limits (storage, surveys, participants, or other resources):

  1. 1-month reduction period: You have 1 month to reduce your Resource Usage to within the Free Plan limits
  2. Email warning: We'll send you an email warning at least 7 days before any resources are automatically deleted, giving you ample opportunity to manage your resources
  3. Automatic deletion: After 1 month, if your Resource Usage still exceeds limits, the system will automatically delete Resources in order from oldest to newest until your Resource Usage is within permitted limits
  4. Warning: Depending on the size and number of resources, this may result in total deletion of all resources. This action is irreversible.

You're responsible for managing your resources when downgrading or reverting to the Free Plan. We strongly recommend exporting any important data before the 1-month period ends.

5. Cancellation and Deletion

Cancelling a Subscription

Cancel anytime through your project settings or by opening a support ticket from your account. When you cancel:

  • You keep paid features until the end of your billing period
  • No refund (except within the 14-day guarantee period, and only if this is your first paid subscription on this Project)
  • Your Project automatically reverts to the Free Plan (see Section 4 for Free Plan limitations, including resource limits and project creation restrictions)
  • All data is preserved, but you must ensure your Resource Usage complies with Free Plan limits within 1 month

Deleting Content Within a Project

Deleting an individual survey, response, or other item within a Project (rather than the Project itself) is immediate and irreversible. Export any data you want to keep first.

Deleting a Project

Deletion is not immediate: a 1-month restore window applies. When you delete a Project, it is deactivated immediately and no longer accessible or usable, but your data is retained for 1 month. During this window, the Project appears in your Recently Deleted list, where you can restore it yourself with the Restore button. After 1 month, all surveys, responses, and data are permanently deleted and cannot be recovered. If the Project has a paid subscription, it's cancelled with no refund. Export any data you want to keep first. You may also choose to permanently delete a Project immediately from the Recently Deleted list, skipping the 1-month restore window - this is useful if you want to reuse the Project's subdomain right away, and cannot be undone.

Deleting Your Account

Deletion is not immediate: a 1-month restore window applies. Deleting your account deactivates all Projects and data across your account immediately, but your data is retained for 1 month. You can reactivate your account yourself by logging in again within the 1-month window. After 1 month, all Projects and data are permanently deleted and cannot be recovered. All subscriptions are cancelled with no refunds (except as required by law). Export any data you want to keep first.

If We Terminate Your Account

We can suspend or terminate your account if you:

  • Violate these Terms
  • Don't pay your subscription
  • Use the Services illegally
  • Violate the Acceptable Use Policy
  • Pose a security risk or harm other users

We'll try to notify you first unless immediate termination is needed for safety or legal reasons. If we terminate for cause, no refund is provided. We may give you 1 month to export your data (except for serious violations).

6. Your Rights and Responsibilities

What You Can Do

You can use VeySur for your business or personal purposes according to your subscription plan. You can't:

  • Resell or sublicense the Services
  • Access the Services for benchmarking purposes

Your Legal Obligations

You must comply with all applicable laws, including:

  • Data protection: Follow GDPR, UK GDPR, and other privacy laws when collecting survey responses. Get necessary consents, provide privacy notices, and respect participant rights.
  • Anti-spam: Comply with anti-spam laws (CAN-SPAM, CASL) when distributing surveys
  • Intellectual property: Don't infringe others' copyrights or trademarks
  • Export control: Comply with sanctions and export regulations

Your Content

You're solely responsible for all surveys, questions, and responses you create or collect. You confirm that:

  • You own or have permission to use all Content
  • Your Content doesn't violate anyone's rights
  • Your data collection complies with privacy laws

Participant privacy: When collecting responses, you must provide clear information about data use, get required consents, respect participant rights, and implement appropriate security.

Prohibited Activities

You can't:

  • Violate laws or third-party rights
  • Interfere with or disrupt the Services
  • Try to access our systems without authorisation
  • Transmit malware or harmful code
  • Use bots or scrapers without permission
  • Impersonate others
  • Overload our infrastructure

7. Acceptable Use Policy

Permitted Uses

VeySur is for legitimate survey purposes like market research, customer feedback, academic research, employee surveys, and event feedback.

What You Can't Create or Collect

Don't use VeySur for Content that:

  • Violates laws or promotes illegal activity
  • Infringes intellectual property rights
  • Harasses, threatens, or promotes hate or discrimination
  • Contains pornography or sexually exploits minors
  • Involves scams, phishing, or fraud
  • Contains malware or harmful code
  • Violates privacy rights
  • Encourages self-harm or dangerous behaviour

Prohibited Conduct

Don't:

  • Send spam or unsolicited survey invitations
  • Use purchased email lists without proper permissions
  • Disguise the origin or purpose of surveys
  • Collect sensitive data (health, biometric, financial) without proper legal basis
  • Share your login credentials
  • Bypass usage limits or security measures

Spam Rules

Only send surveys to people who reasonably expect to hear from you or have consented. Clearly identify yourself, accurately describe the survey purpose, honour opt-out requests, and comply with anti-spam laws.

Enforcement

If you violate this policy, we can remove Content, suspend access, terminate your account, or report you to authorities. The action depends on the severity of the violation. You're responsible for all activity under your account.

8. Our Rights and Obligations

What We Provide

We'll use reasonable efforts to:

  • Maintain the security and integrity of the Services
  • Protect your data per our Privacy Policy and DPA
  • Provide customer support (channels depend on your plan)
  • Notify you of material changes to the Services or Terms
  • Target 99% monthly uptime (excludes scheduled maintenance, emergencies, and issues outside our control)

Monitoring and Content Removal

We can (but don't have to) monitor use of the Services and review Content to ensure compliance with these Terms and laws. We can remove Content that violates these Terms, applicable laws, or poses security risks. We'll try to notify you if we remove Content unless doing so would violate the law or compromise security.

We don't pre-screen Content before you create it. You're solely responsible for your Content regardless of whether we monitor.

Changes to the Services

We can modify, update, or discontinue features anytime. We'll try to notify you of material changes that significantly reduce functionality, but we may make immediate changes for security, legal compliance, emergency maintenance, or changes that don't affect core functionality.

Maintenance

Scheduled maintenance: We'll give you at least 24 hours' notice and minimise disruption.

Emergency maintenance: We can perform unannounced maintenance for critical security issues, data loss prevention, outages, or legal requirements. We'll notify you as soon as reasonably possible.

Support

We offer support via the support ticket system accessible from your account, with email (support@veysur.com) available as an alternative. Support channels vary by plan:

  • Free Plan: Support ticket, email, and help center on a best-effort basis
  • Paid Plans: Support ticket, email, and help center with priority handling

We aim to respond as promptly as we can, though we don't guarantee specific response times. Support is provided in English.

9. Data Protection and Privacy

Your Data

You own your data. We claim no ownership of your surveys, responses, or Content. You can export or delete your data anytime (subject to your plan limits).

Our Policies

Our Privacy Policy explains how we collect and use personal data. Our Data Processing Agreement sets out our responsibilities under GDPR and similar laws: the UK DPA applies to UK data protection law and the EU DPA applies to EU data protection law. If you collect personal data from survey participants, review and accept the DPA that applies to you.

License to VeySur

To provide the Services, you grant us a limited licence to host, store, process, transmit, and back up your Content. This licence only enables us to provide the Services; we don't own your Content or use it for other purposes. The licence ends when you delete your Content or account.

Usage Analytics

We may collect aggregated, anonymous usage statistics (login times, feature usage, performance metrics) to improve the Services. We don't analyse the content of your surveys or responses for analytics. We only aggregated usage statistics that can't be traced back to you.

10. EU Digital Services Act and Data Act

VeySur is established in the United Kingdom and not in the European Union. As the Services are offered to users in the EU, we are required under Article 13 of Regulation (EU) 2022/2065 (the Digital Services Act) to designate a legal representative in an EU member state.

Our designated legal representative is set out in our Legal Notice. You may contact our legal representative, or us directly at support@veysur.com, regarding matters within the scope of the Digital Services Act.

We are also required under Article 37(11)–(14) of Regulation (EU) 2023/2854 (the Data Act) to designate a legal representative in the European Union for matters relating to our obligations under the Data Act. Our designated Data Act representative is set out in our Legal Notice. You may contact our representative, or us directly at support@veysur.com, regarding matters within the scope of the Data Act.

11. Third-Party Services

We use third-party services including:

  • Stripe for payment processing
  • Data centre providers for infrastructure
  • Analytics services for platform improvements

Your use may be subject to third-party terms. We're not responsible for third-party practices, policies, or performance. Payment disputes are handled per Stripe's policies.

We don't endorse or warrant third-party services. We can change or remove third-party integrations anytime.

12. Intellectual Property

VeySur's IP

VeySur owns all rights to the Services, including the platform, software, website, trademarks, and documentation. These Terms don't give you ownership rights. You can't copy, modify, reverse engineer, or create derivative works of the Services.

Your Content

You own all rights to your Content. We don't claim ownership. See Section 9 for the limited license you grant us to provide the Services.

13. Warranties and Disclaimers

Our Warranty

The Services will perform materially as described in our documentation. If not, we'll try to fix the issue or, if we can't, terminate your subscription plan and refund prepaid fees for the unused portion of your subscription plan on a pro-rata basis. Your account remains accessible and your Project reverts to the Free Plan. This warranty refund is separate from and in addition to the 14-day money-back guarantee in Section 4, and applies at any time during your subscription if the Services materially fail to perform as documented.

This warranty doesn't apply to issues caused by your misuse, your equipment, third-party services, or beta features. Free Plan services are provided "as is."

Disclaimer

Except for the warranty above, the Services are provided "as is" and "as available" without warranties of any kind. We disclaim all implied warranties including merchantability, fitness for purpose, and non-infringement.

We don't guarantee the Services will be uninterrupted, error-free, or meet all your requirements. We don't guarantee specific results like response rates or survey success.

UK Consumer Rights: Nothing in these Terms excludes your statutory rights under the Consumer Rights Act 2015. If you're a consumer, you have legal rights if services aren't provided with reasonable skill and care. These rights aren't affected by these Terms.

EU Consumer Rights: If you're a consumer resident in the EU, nothing in these Terms affects the mandatory consumer protection rights under the law of your country of residence.

14. Limitation of Liability

Liability Limit

Our total liability for any claims is limited to the amount you paid us in the 12 months before the claim. For Free Plan users who paid nothing, our liability is limited to zero (except as required by law).

We're not liable for indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, goodwill, or business interruption.

Exceptions

Nothing limits our liability for:

  • Death or personal injury from our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that can't be limited under law

If you're a consumer: Nothing affects your statutory rights under the Consumer Rights Act 2015. We're responsible for foreseeable loss or damage from our breach or negligence, but not for unforeseeable loss.

If you're a business: You agree the Services are for business use only and will indemnify us from third-party claims arising from your commercial use.

These limitations reflect a fair allocation of risk and are essential to the basis of our agreement. The fees charged reflect these limitations.

15. Disputes

Resolution Process

Before formal legal proceedings, contact us at support@veysur.com to resolve disputes informally.

Governing Law

These Terms are governed by the laws of England and Wales.

Jurisdiction

Business users: English courts have exclusive jurisdiction.

Consumer users: You can bring proceedings in English courts or the courts where you live. We can only bring proceedings against you in the courts where you live.

Nothing affects your statutory consumer rights.

16. Consumer Right of Withdrawal

For consumers only: Before subscribing to a paid plan, you can try VeySur's Free Plan with no payment and no obligation. If you're a consumer and choose to subscribe to a paid plan, UK and EU law gives you a 14-day right to withdraw from that purchase.

Immediate performance: Paid plans take effect immediately on purchase, giving you instant access to paid features and resource limits, at your request. By subscribing, you're asking us to begin performance immediately rather than waiting out the 14-day window. Under consumer law, this means you may lose the statutory withdrawal right once performance has started, as you'll have received what you paid for.

Our guarantee instead: Regardless of the above, we offer better than the statutory minimum: our 14-day money-back guarantee (Section 4) refunds your first payment in full, no reason required, even after you've started using paid features. This gives you the same 14-day protection as the statutory right, without the "no immediate performance" restriction: cancel and get refunded even if you've already used what you bought.

If you'd rather not request immediate performance, contact us at support@veysur.com before upgrading and we'll hold activation until the standard withdrawal window would otherwise apply.

17. Changes to These Terms

We can modify these Terms anytime. For material changes (significant fee increases, reduced functionality, changes to data practices, liability limitations, or termination rights), we'll give you 1 month's notice by email and website announcement.

Continuing to use the Services after changes take effect means you agree to the updated Terms. If you don't agree, cancel your subscription and stop using the Services.

18. General Terms

Entire Agreement

These Terms, our Privacy Policy, and our Data Processing Agreement are the complete agreement between us.

Severability

If any provision is invalid or unenforceable, it will be limited to the minimum necessary extent, and the rest of the Terms remain in effect.

No Waiver

Our failure to enforce any provision doesn't waive our right to enforce it later. Waivers must be in writing.

Assignment

You can't assign these Terms without our written consent. We can assign them to affiliates, in mergers/acquisitions, or by law.

Notices

Notices must be in writing:

  • To you: By email to your registered email address
  • To us: By email to support@veysur.com or mail to VeySur Limited, c/o DoES Liverpool, 1st Floor, The Tapestry, 68-76 Kempston Street, Liverpool, L3 8HL

Keep your email address current. We're not responsible if notices don't reach you due to outdated contact info.

Relationship

We're independent contractors. Nothing creates a partnership, joint venture, or agency relationship.

No Third-Party Beneficiaries

These Terms are only for your and our benefit. No third parties have rights under these Terms.

Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (natural disasters, wars, government actions, internet failures, cyber-attacks, pandemics). The affected party will notify the other promptly and work to minimize impact.

Language

These Terms are in English. If translated, the English version governs any conflicts.

Survival

These sections survive termination: Content Responsibility, Customer Content Ownership, Warranties and Disclaimers, Limitation of Liability, Dispute Resolution, and General Provisions.
